1. Introduction and Acceptance

These Website Terms of Use ("Terms") govern your access to and use of the websites theworthyleader.com and innovative-formula.com, together with any successor or replacement domain operated by us for the same purpose (each and collectively, the "Site"), operated by Innovative Formula Sdn Bhd (Company No. 571386-A), a company incorporated in Malaysia with its registered address at Penthouse (Level 27) Centrepoint South, The Boulevard, Mid Valley City, Lingkaran Syed Putra, 59200 Kuala Lumpur, Malaysia ("IF Leadership", "we", "us" or "our"). These Terms apply equally and in the same form to your use of either website; where a specific website's functionality differs, that difference is noted where relevant.

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site. We may update these Terms from time to time in accordance with Section 12 below.

2. About the Site

The Site provides information about IF Leadership's leadership development services, including Leadership Programmes, Coaching (Executive Coaching, Group & Team Coaching, and Coaching Skills Workshops), and Strategic Facilitation, and allows visitors to submit enquiries through contact and lead-capture forms. The Site does not currently process payments, host user accounts, or facilitate online bookings. If any such functionality is introduced in future, these Terms will be updated accordingly, and additional terms (for example, specific booking or payment terms) may apply at that time.

3. Permitted Use

You may access and use the Site for lawful, personal, and non-commercial purposes connected to evaluating or engaging IF Leadership's services. You agree not to:
●   Use the Site in any way that breaches applicable law or regulation in Malaysia or any other jurisdiction from which you access the Site;
●   Attempt to gain unauthorised access to the Site, its servers, or any systems or networks connected to the Site;
●   Introduce viruses, malware, or other harmful material to the Site;
●   Scrape, harvest, or otherwise systematically extract content or data from the Site without our prior written consent;
●   Use the Site to transmit unsolicited advertising or promotional material;
●   Misrepresent your identity or affiliation when submitting any form on the Site.
We reserve the right to restrict or terminate your access to the Site if we reasonably believe you have breached these Terms.

4. Intellectual Property

Unless otherwise indicated, all content on the Site — including text, graphics, logos, the IF Leadership name and marks, methodology descriptions, programme materials, images, and the overall design and layout of the Site — is owned by or licensed to Innovative Formula Sdn Bhd and is protected by copyright, trademark, and other intellectual property laws.
You may view and print pages from the Site for your own personal, non-commercial reference. You may not reproduce, republish, distribute, modify, or create derivative works from any content on the Site without our prior written consent, except as permitted by applicable law.
Any trademarks, logos, or names of client organisations referenced on the Site (for example, in testimonials or client lists) remain the property of their respective owners and are used with permission or in a purely descriptive, non-endorsement-implying context, as applicable.

5. Submissions and Enquiries

Where you submit information to us through a form on the Site (for example, a contact, enquiry, or newsletter sign-up form), you confirm that the information you provide is accurate and that you have the right to provide it. Submitting an enquiry does not create a contractual relationship between you and IF Leadership; any engagement for services is subject to separate written agreement.
Personal data you submit is handled in accordance with our Privacy Policy [INSERT LINK], which explains what data we collect, how it is used, and your rights in relation to it under the Malaysian Personal Data Protection Act 2010 and, where applicable, the data protection laws of other Southeast Asian jurisdictions in which you are located.

We do not control and are not responsible for the content, accuracy, or practices of any third-party website. Inclusion of a link does not imply endorsement. 7. No Professional or Outcome Guarantee

Content on the Site — including descriptions of our approach, programmes, and client experiences — is provided for general informational purposes and reflects our general approach to leadership development. It does not constitute a guarantee of any particular result, and it is not a substitute for a formal scope of work, proposal, or engagement agreement, which will govern the specific services, deliverables, and terms of any engagement with IF Leadership.

8. Disclaimers

To the fullest extent permitted by applicable law, the Site and its content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including (without limitation) warranties of accuracy, completeness, availability, or fitness for a particular purpose.
We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected. You are responsible for taking your own precautions (such as virus-scanning software) when accessing the Site.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Innovative Formula Sdn Bhd, its directors, employees, and associates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your access to or use of (or inability to access or use) the Site, even if we have been advised of the possibility of such damages.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including (where applicable) liability for death or personal injury caused by negligence, or liability for fraud or fraudulent misrepresentation.

10. Indemnity

You agree to indemnify and hold harmless Innovative Formula Sdn Bhd and its directors, employees, and associates from and against any claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Site.

11. Governing Law and Jurisdiction

These Terms are governed by, and construed in accordance with, the laws of Malaysia. You and IF Leadership submit to the exclusive jurisdiction of the courts of Malaysia in relation to any dispute arising out of or in connection with these Terms or your use of the Site.
IF Leadership provides services to clients across Southeast Asia, including in Singapore, Indonesia, and Thailand. If you access or use the Site from outside Malaysia, you do so on your own initiative and are responsible for compliance with local laws where they apply. Nothing in these Terms is intended to override any mandatory local consumer protection or data protection law that applies to you and cannot be contractually excluded.

12. Changes to These Terms

We may revise these Terms from time to time to reflect changes to the Site, our services, or legal and regulatory requirements. The "Last updated" date at the top of this page indicates when the Terms were last revised. Continued use of the Site after any changes take effect constitutes your acceptance of the revised Terms.

13. Termination

We may suspend or restrict your access to the Site, without notice, if we reasonably consider that you have breached these Terms or that such action is necessary to protect the Site, our users, or third parties.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

Privacy Policy

1. Introduction

Innovative Formula Sdn Bhd (Registration No. 571386-A) ("IF", "we", "us" or "our") operates innovative-formula.com (the "Site") and provides leadership development, executive coaching, and strategic facilitation services across Southeast Asia. Innovative Formula Sdn Bhd also owns and operates theworthyleader.com; this Policy applies equally to personal data collected through that site, and any reference to the "Site" below should be read to include both. This Privacy Policy explains how we collect, use, disclose, and protect personal data when you visit either site, submit an enquiry, register for a programme, or otherwise interact with us.

This Policy is intended to comply with the Personal Data Protection Act 2010 (PDPA) of Malaysia. If you are located outside Malaysia, please see Section 11 (Cross-Border Transfer of Data) and Section 15 (Regional Users) for how this Policy applies to you.

2. Scope of This Policy

This Policy applies to personal data we collect through:

The Site, including contact forms, programme enquiry forms, newsletter sign-ups, and any other lead-capture forms;
Direct communications with you, including email, phone, and in-person or virtual meetings arranged as a result of your enquiry;
Participation in our leadership programmes, coaching engagements, or facilitation sessions, where separate participant agreements or consent forms may also apply.

This Policy does not apply to third-party websites linked from the Site, which are governed by their own privacy policies (see Section 13).

3. Who We Are — the Data Controller

For the purposes of the PDPA, the data controller ("data user") responsible for personal data collected through the Site is:

4. Personal Data We Collect

We collect personal data that you provide to us directly, and limited data collected automatically when you use the Site.

4.1 Data you provide directly

Identity and contact data: name, job title, organisation name, email address, phone number;
Enquiry content: the details of your message, the programme(s) or service(s) you are interested in, and any other information you choose to include in a form or email;
Programme participation data: information provided when registering for or attending a leadership programme, coaching engagement, or facilitation session (this may be covered by a separate participant agreement).

We do not knowingly collect financial information, government ID numbers, or other sensitive personal data through the Site's lead-generation forms. Where sensitive personal data is required for a specific engagement (for example, as part of a coaching intake process), we will seek your explicit consent separately.

4.2 Data collected automatically

Technical data such as IP address, browser type, device type, and general location (country/region level), collected via the Site's hosting platform and any analytics tools in use;
Usage data such as pages visited, time spent on the Site, and referral source, collected via cookies or similar technologies (see Section 9).

5. How We Collect Personal Data

When you complete a contact, enquiry, or newsletter sign-up form on the Site;
When you email, call, or otherwise correspond with us directly;
When you register for or attend a programme, coaching session, or facilitation engagement;
Automatically, through cookies and similar technologies, when you browse the Site (see Section 9).

6. Purposes for Which We Use Your Personal Data

We use personal data for the following purposes:

To respond to your enquiry and follow up on requests to "start a conversation";
To assess your organisation's needs and prepare a recommendation for leadership programmes, coaching, or facilitation services;
To administer and deliver programmes, coaching engagements, or facilitation sessions you or your organisation have registered for;
To send you information you have requested, such as programme brochures or our approach materials;
Where you have separately consented, to send occasional updates or insights relevant to leadership development;
To maintain business records, and to comply with applicable legal, accounting, or regulatory obligations;
To maintain the security and proper functioning of the Site.

We do not use your personal data for purposes incompatible with those stated above without first notifying you and, where required, obtaining your consent.

7. Consent and Legal Basis for Processing

Under the PDPA's General Principle, we process personal data on the basis of your consent, which you provide when you submit a form or otherwise share your details with us. You may withdraw consent at any time (see Section 12), though this may limit our ability to respond to your enquiry or continue delivering a service you have requested.

Where processing is necessary to perform a contract with you or your organisation (for example, delivering a programme you have registered for), or to comply with a legal obligation, we may rely on that basis in addition to, or instead of, consent.

8. Disclosure of Personal Data to Third Parties

We do not sell personal data. We may disclose personal data to the following categories of recipients, only as needed for the purposes described in Section 6:

Service providers who support our operations, such as our website hosting and CMS platform (Wix), email and communications tools, and, where engaged, analytics or CRM providers;
Coaches, facilitators, and associates engaged by IF to deliver a specific programme or engagement you or your organisation have registered for;
Professional advisers (legal, accounting) where necessary for our business operations;
Regulators or authorities, where required by law.

9. Cookies and Similar Technologies

The Site may use cookies and similar technologies to support core functionality and, where enabled, to understand how visitors use the Site. This may include:

Essential cookies required for the Site to function correctly;
Analytics cookies (if enabled) to help us understand visitor behaviour in aggregate;
Preference cookies to remember choices you have made on the Site.

10. Data Security

We take reasonable technical and organisational measures to protect personal data against loss, misuse, unauthorised access, disclosure, alteration, or destruction, consistent with the PDPA's Security Principle. These measures include access controls on our systems and reliance on reputable third-party platforms (such as Wix) for hosting and form submission handling.

No method of transmission or storage is completely secure. If we become aware of a data breach affecting your personal data, we will take appropriate steps in line with our legal obligations, including notifying the Personal Data Protection Commissioner where required.

11. Data Retention

We retain personal data only for as long as necessary to fulfil the purposes described in Section 6, or as required by applicable law, whichever is longer. As a general guide:

Enquiry and lead data from visitors who do not proceed with an engagement is retained for a limited period and then deleted or anonymised;
Data relating to active or completed client engagements is retained for the duration of the engagement and for a further period afterward to meet contractual, accounting, or legal record-keeping obligations.

12. Your Rights as a Data Subject

Subject to the PDPA and its exceptions, you have the right to:

Access the personal data we hold about you;
Request correction of personal data that is inaccurate, incomplete, or out of date;
Withdraw consent to our processing of your personal data, or limit the processing of your personal data, by notice in writing;
Request information on the types of personal data we hold about you and the purposes for which it is processed.

To exercise any of these rights, please contact us at enquiry@innovative-formula.com. We will respond within the timeframe required under the PDPA. We may need to verify your identity before actioning a request, and certain requests may be subject to a reasonable processing fee as permitted under the PDPA.

13. Third-Party Links

The Site may contain links to third-party websites. This Policy does not apply to those websites, and we encourage you to review their respective privacy policies before providing any personal data.

14. Children's Data

The Site and our services are directed at working professionals and organisations. We do not knowingly collect personal data from children. If you believe a child has provided personal data to us, please contact us so we can remove it.

15. Regional Users Outside Malaysia

As IF works with organisations and leaders across Southeast Asia, we may receive enquiries and personal data from individuals located outside Malaysia. Where your local law provides you with additional or different data protection rights, those rights are not limited by this Policy. If there is a conflict between this Policy and mandatory local law that applies to you, the mandatory local law will prevail to the extent of that conflict.

16. Cross-Border Transfer of Data

Where personal data is transferred outside Malaysia — for example, to a service provider's servers located in another country — we take steps intended to ensure the data continues to receive an appropriate standard of protection.

17. Changes to This Policy

We may update this Policy from time to time to reflect changes in our practices or legal requirements. The "Effective date" at the top of this Policy indicates when it was last revised. Material changes will be notified on the Site.
